THE SHORT ANSWER
In Great Britain, being on probation does not by itself decide your notice period. Identify whether you are resigning or the employer is dismissing you, read the applicable contract and probation wording, and check the relevant statutory minimum. Confirm the notice start date and last employment day rather than assuming a probation end date settles them.
Your contract says one week's notice during probation and one month's notice afterwards. The probation date passed, but no one confirmed anything. You want to leave—or your employer has just told you the job is ending. Which sentence applies?
Begin with who is giving notice, then identify which contractual stage applies. This guide concerns people with the legal status of employee in England, Wales and Scotland, not Northern Ireland. Sources were checked on 23 October 2026. Employment status, dismissal rights and notice are connected questions, but they are not interchangeable.
Resignation and dismissal use different minimum rules
The Acas resignation guidance and dismissal or redundancy guidance describe different statutory minimums.
| Who is ending employment? | Starting point for statutory notice | What else to read |
|---|---|---|
| Employee resigns after at least one month's service | Normally at least one week's notice | The contract, written statement or policy may require longer resignation notice. Exceptions and agreed alternatives need separate attention. |
| Employer dismisses after one month but before two years' service | Normally at least one week's notice | A longer contractual employer notice period may apply. |
| Employer dismisses after two or more years | Normally one week per completed year, capped at 12 weeks | Compare the contractual entitlement and check any relevant exception. |
| Less than one month's service | Do not assume the statutory week has started | Check the agreement. Acas says an employee resigning before one month need not give notice if the written statement does not specify it. |
These are starting rules, not an instruction to leave immediately. Acas discusses exceptions such as gross misconduct for employer notice and serious contractual breach affecting resignation. An agreed shorter arrangement should be recorded in writing. Do not use an allegation of misconduct or breach as a shortcut to assume no notice is required.
Put the probation and notice clauses beside each other
Use this five-line comparison:
- Start date and service: your actual employment start date and continuous-service facts.
- Probation: stated length, review date, extension power and any written-confirmation requirement.
- Notice during probation: quote both the employee's and employer's obligations if they differ.
- Notice afterwards: identify whose notice period it describes and when it becomes applicable.
- Giving notice: recipient, delivery method, receipt rule and when the period starts.
If an offer letter, contract and staff policy differ, flag the conflict. Do not choose the shortest sentence because it appears in the document you read first. The job-contract checklist helps organize the rest of the document pack.
The probation date passed, but nobody confirmed it
There is no safe reading shortcut that says “no email means I passed” or “no email means probation continues forever.” Read whether the contract ties the change to elapsed time, successful completion, written confirmation or a valid extension. Check actual communications and any maximum extension period.
Here are fictional examples showing why the wording changes the question:
| Assumed wording | Question to resolve |
|---|---|
| “During the first three months, either party gives one week's notice; thereafter one month” | Which stage had been reached when notice was given, and does another term qualify this wording? |
| “Probation is three months and may be extended by written notice” | Was an extension issued as required, and what new date was stated? |
| “The ordinary notice period applies following written confirmation of successful probation” | What does the complete agreement say about delay or absence of confirmation? |
These examples do not decide the legal effect of silence in a particular case. Get the employer's interpretation and supporting clause in writing while there is still time to resolve the difference.
A worked notice calendar
Assume a fictional resignation: the employee tells the employer on Monday 2 November 2026, the applicable notice is one calendar week, and the contract does not specify another starting rule. Acas says that in this situation notice starts the day after the employee tells the employer.
- Notice given: Monday 2 November.
- First notice day: Tuesday 3 November.
- Seventh notice day: Monday 9 November.
- Assumed last employment day: Monday 9 November, subject to confirmation of these assumptions.
This example is not seven working days. A calendar month is also not automatically four weeks. Check the actual unit, method of delivery and any alternative agreement. Employer notice delivered in writing can have different receipt/read-timing considerations; see Acas on when notice starts.
A clarification email before committing to dates
Please confirm which notice provision applies to [my proposed resignation / the dismissal notice], given my start date of [date] and the probation wording in clause [number]. I have [received/not received] written confirmation or an extension dated [date]. My reading is [period], starting [date], with employment ending [date]. Please identify any different clause or date you rely on, and confirm whether I should work the period or whether another arrangement is proposed.
Choose one situation and remove the unused alternative. This is a clarification request, not a resignation template: do not accidentally give notice before you intend to.
Keep notice separate from the rest of the exit
Acas's probation-dismissal guidance, updated 7 October 2026, says employers must give the correct statutory or contractual notice and follow the relevant process. A short probation notice period is not an answer to every question about fairness or other employment rights.
Also check final pay, holiday, equipment return, confidentiality and any training-cost repayment clause. A repayment term is not itself a notice period. The continuing-obligations register can help keep the remaining tasks visible.
An AI review can locate conflicting clauses and produce questions. It cannot decide your employment status, guarantee a dismissal is lawful or replace a fact-specific answer where the dates or terms are contested.
